Kirby Vacuum, the $ 2400.00 vacuum cleaner:
Scams Consumers; and fails to pay their workers.

On Tuesday, 15 January 2008, I responded to an advertisement on
Craigslist, under the Section: "Customer Service Jobs". There was no
mention at all of Kirby Vacuum Cleaners, absolutely no mention of door
to door knocking to set up your own appointments, nor door to door Sales
- as these happen to be the two key components of the job.

The Ad read very much like this one: (the typo is theirs; not mine)

Right from the beginning, their intent is to deceive and to scam. There
is no mention of Kirby Vacuum, no mention of door to door knocking to
secure appointments; and no mention of door to door sales. If their
intentions are honest; why the dishonest ad.

On Day One of the training, which began Thursday, 17 January 2008, we
were promised $ 2,000 upon completion of fifty-two appointments in
thirty days.

Before the last day of the class we were asked to identify five (5) to
ten (10) good friends who would allow us to demonstrate the Kirby Vacuum
Cleaner in their home. But, when I got to my first friend's house, my
(telephone) trainer engaged in this totally unexpected (and very
uncomfortable and very heavy) sales pitch - getting a "good" friend to
buy a $ 2400 Kirby Vacuum Cleaner was never, never a part of any
discussion that took place during our three-day training. If their
intentions are honest; why the dishonesty.

For each appointment I maintained a name, address and telephone log;
which I have since learned that most people dealing with door to door
sales people do not offer their correct telephone number because they do
not want to be bothered with a million solicitation calls. Although, I
am just learning about human nature, JM Enterprises (the Kirby Vacuum
Dealership) in South San Francisco Kirby Vacuum Cleaner

nature"; and, obviously they have been through this situation, many,
many, many times before; and, they knew that they would never be able to
verify the appointments - even when they shook my hand and welcomed me
aboard they knew they would never have to pay me the

not tolerated well by Americans; especially when it occurs overseas.

The following information is background and "supplemental nice to know
information":

(1) JM Enterprises is an example of why we MUST have unions
in the workplace. They do expect you to work seven days a week. If you
miss a day of work you can look forward to being punished by being sent
to a "poorer" or "BK Neighborhood" as they call them (BK: Bankrupt and
Broke) during the following week. They will not give you breaks; and,
if you appear to be breaking you can look forward to a lousy
neighborhood the following week. In the January and February Rain and
Wind STORMS, we were out, with no gear or protection from the elements,
knocking door to door (which seemed to be an exercise in futility: who
is going to let a soaking dripping wet person with totally soaked shoes
into their house to clean a carpet. So, you find yourself going door to
door knocking up to six hours without any breaks. The day began at 10am
and we were expected to be on the Street and accepting appointments
until 9pm. Again, how many people are going to let total strangers into
their home after dark; it's all an exercise in futility. We returned to
the Office daily about 10pm - most times 11; and once at 1am. Not only
do they not want to honor their commitments, they feel no guilt or shame
about their well-thought out scam against consumers and its independent
contractors (as we were called; though clearly, very clearly: we were
employees - they just don't want to pay payroll taxes)

(2) I am hoping that my appointments, when they see my face
on TV, will pick up the phone and voluntarily inform JM Enterprises,
that Ken Jones was a perfect gentleman. He interacted well with the
family and our pets. And, he did an outstanding job shampooing our
carpet. And pay the man for the work that was completed and completed
WELL!

(3) JM Enterprises' latest spin is that they do not owe me
any money because I did not sell any vacuums (more accurately, I sold
two; and could have sold two more if managers had been in their places
at agreed upon times). None the less, Mr. Jared's final remarks to me
were: " I do not believe that you completed fifty two complete
demonstrations because you would have sold 52 Kirby Vacuum Cleaners".

Ok, what do we do with those words?; and, that level of arrogance? How
do you deal with this type of Business? They are convinced they are
UNTOUCHABLE.

I need you. I really, really need your help; and, its much, much bigger
than just me. This is really about Worker's Rights all over the World:
INCLUDING The United States of America.

I need you to give Kirby Vacuum a call; and, let them know that you
think their scam is deplorable; and, when they knock on your door - turn
off your lights and hide!

(And please forward this communication to your entire address book; it
is hard to hear one voice - it is IMPOSSIBLE not to hear a thousand
voices.)
